FULLGENOMICS, S.L. (hereinafter “the company”), headquartered at C/ TUSET 23, 6º 1ª, 08006, BARCELONA (BARCELONA), whose Tax ID is B90340811 and who is registered in the Mercantile Registry of Seville, Volume 6437, Sheet 1, Page SE-115176.

Advises as follows:

The use of the domain name www.fullgenomics.es has been duly registered by the company, with all necessary guarantees, as provided for in Law 34/2002 of 11 July, the Law on the Services of the Information Society and on Electronic Commerce. Nevertheless, we would highlight the fact that these Legal Terms are fully adapted to current regulations on Data Protection, Electronic Commerce, Contracting Conditions, Intellectual Property and other subsidiary provisions.

1. Acceptance of the legal terms

A. Access to this website or using the site in any way implies acceptance of each and every one of these Legal Terms, with the company reserving the right to modify them at any time. Consequently, every visitor and/or User will be responsible for carefully reading the Legal Terms of Use in force on each one of the occasions on which they access this website, and, if they are not in agreement with any such terms provided for herein, they must refrain from using this website.

2. Subject

A. Through the website www.fullgenomics.es, Users are provided with access to various types of content, services, information and data (the “content”), which is made available to them. The company reserves the right to modify at any time the presentation, configuration and location of the website, as well as the content, products and services provided.

3. Conditions of access

B. Access to the information on the different products and services existing on the website, as well as any browsing on the website, will be free and free of charge, with Users therefore not being required to complete the corresponding registration, thereby providing their personal data or using codes or passwords.

B. Where it is necessary to provide personal data for access to certain content or services, Users will guarantee the veracity, accuracy, authenticity and validity of such data. The company will automatically process said data accordingly depending on its nature or purpose, under the terms set out in the Data Protection Policy section.

4. Conditions of use

A. Users undertake to make appropriate and lawful use of the website, and of the content and services, in accordance with the legislation applicable at any time, the Legal Terms of the website, generally accepted ethics and morality and public policy. Users must refrain from:

Introducing or spreading computer viruses or any other physical or logical systems that are likely to cause damage to the physical or logical systems of the company, its suppliers or third parties;
Attempting to access, use and/or manipulate data of the company, third party suppliers and other Users;
Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying content, unless they have the express authorisation of the holder of the corresponding rights or unless this is permitted by law;
Deleting, concealing or manipulating notes on intellectual or industrial property rights and other data identifying rights of the company or of third parties incorporated into the content, as well as technical protection devices or any information mechanisms that may be inserted into the content;
attempting to obtain any personal data other than the data they are authorised to know about, and this by deploying means or procedures that are unlawful, fraudulent or that may cause any type of damage. (Cf. Viruses, Trojans, bugs, Worms, etc.);
In particular, Users undertake inter alia, for illustrative purposes only, not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:
- Is in any way contrary to, discounts or infringes fundamental rights and public freedoms recognised constitutionally, under International Treaties and by remaining legislation;
- Induces, incites or promotes acts of discrimination or discriminatory attitudes or thoughts based on sex, race, religion, beliefs, age or social status;
- Incorporates, makes available or allows access to products, components, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, generally accepted ethics and morality or public policy;
- Induces or may induce an unacceptable state of anxiety or fear;
- Induces or incites someone to engage in practices which are dangerous, hazardous or harmful to their health and mental balance;
- Is protected by legislation for the protection of intellectual or industrial property belonging to the company or to third parties without the intended use of such material having been authorised;
- Infringes people’s honour, their private life and family life or their self-image;
- Constitutes any type of advertising; including any type of virus or programme that prevents the normal functioning of the website.
- Induces, incites or promotes criminal, denigratory, defamatory or violent acts or, in general, acts contrary to the law, generally accepted ethics and morality or public policy;

5. Responsabilities

A. The company guarantees neither continuous access to nor the proper display, download or usefulness of the elements and information contained on the company’s websites, which may be impeded, hindered or interrupted by factors or circumstances that are beyond its control.

B. The company may interrupt the service or immediately terminate the relationship with the User if it detects any use of its Portal or of any of the services offered therein which is contrary to these Legal Terms.

C. The company makes an email address mpalahi@fullgenomics.es available to Users to ensure that any content that may affect the activity of other users is flagged up, with the intention of rectifying this where appropriate.

D. The company shall not assume liability for damages, losses, claims or expenses caused by or incurred as the result of:

Interference, interruptions, failures, omissions, telephone faults, delays, blockages or disconnections in the operation of the electronic system caused by deficiencies, overloads and errors in telecommunications lines and networks, or by any other cause beyond the company’s control;
Unlawful intrusions through the use of malicious programmes of any kind and via any means of communication, such as computer or any other viruses;
Improper or inappropriate misuse of the company’s websites;
Security or browsing errors caused by a malfunction of the browser or by using versions of the browser that have not been updated. The company’s directors reserve the right to withdraw, in whole or in part, any content or information present on the website.

E. The company rules out any liability for damages of any kind that may be due to misuse of the services, which are freely available and may be freely used by online users. Likewise, the company shall be exempt from any liability for content and information that may be received in consequence of forms for the collection of data, these being completed solely for the provision of the services described as offered by the company; services such as online commerce and request for quotes. On the other hand, should damages be caused as
the result of the unlawful or incorrect use of said services, users may be sued by the company with respect to such damages caused.

6. Intellectual and industrial property

A. Users hereby acknowledge and accept that all trademarks, trade names or distinctive signs, and all industrial and intellectual property rights over the content and/or any other elements inserted into the website, are the exclusive property of the company and/or third parties, who have the exclusive right to use them for trade. Under no circumstances does access to the website imply any type of waiver, transfer, licensing or total or partial assignment of said rights, unless expressly stated otherwise. These Legal Terms of the Website do not confer on Users any rights of use, alteration, exploitation, reproduction, distribution or public communication of the Website and/or its Content other than those expressly provided for herein. Any other use or exploitation of any rights will be subject to prior, express authorisation specifically granted for such purpose by the company or the third party holder of the rights concerned.

B. The content, texts, photographs, designs, logos, images, computer programmes, source codes and, in general, any intellectual creation existing on this site, as well as the site itself as a whole, as a multimedia artistic work, are protected as copyright by legislation on intellectual property. The company is the owner of the elements that make up the graphic design of its website, the menus, navigation buttons, the HTML code, texts, images, textures, graphics and any other content of the website or has, in any event, the corresponding
authorisation for the use of said elements.

The content provided on said website may not be reproduced in whole or in part or transmitted, or registered by any information retrieval system, in any form or in any medium, without the prior authorisation, in writing, of the aforementioned Entity.

C. Likewise, there is a prohibition on deleting, evading or manipulating the company’s “copyright”, as well as the technical protection devices or any information mechanisms that may contain the content. Users of this website undertake to respect the rights set forth and to avoid any action that might infringe said rights, with the company reserving in any event the right to exercise any remedies or bring any legal action to which it might be entitled in defence of its legitimate intellectual and industrial property rights.

7. Data Protection

A. To use some of the Services, Users must provide certain personal data beforehand. For such purposes, the company will automatically process the Personal Data in compliance with the General Data Protection Regulation 2016/679 of 27 April 2016. In this regard, users may access the policy followed with respect to the processing of personal data (DATA PROTECTION POLICY), as well as the establishment of the previously established purposes, by examining what is provided for in the conditions set out in the Data Protection Policy presented on the website.

8. Duration and Termination

A. The provision of the service on this website and of the other services is in principle of an indefinite duration. Nevertheless, the company may terminate or suspend any of the services of the portal. Where possible, the company will announce the termination or suspension of the provision of the specific service.

9. Force majeure

A. The company will in no way be liable for any inability to provide a service if this is due to prolonged interruptions of the electricity supply or telecommunications lines,social unrest, strikes, rebellion, explosions, floods, Government acts and omissions, and in general all cases of force majeure.

11. Applicable law and jurisdiction

A. These Legal Terms are governed by Spanish law.
